The Insurance Company Already Has a Plan. You Should Too.

After a serious accident, most people assume the insurance company will proactively investigate what happened, accept liability, help with car repairs and offering a rental vehicle, pay the medical bills, and make a fair offer.

That is typically not how the process works.

Before you hang up the phone from your initial conversation with the insurance adjuster, the insurance company is already be working to control the claim. The adjuster calls you while everything is still fresh and confusing and asks for a recorded statement. They want details about how the crash happened, how you are feeling, and whether you have ever had problems with your neck or back or shoulder, etc. before. They want to lock down this information early on in the event they can try to use it to minimize what they pay later.

The insurance company begins building its file almost immediately. It may contact witnesses. Vehicles may be inspected. Photographs, video, electronic data, and other evidence may be gathered. For high exposure claims such as a collision involving a commercial or semi-truck, it may immediately hire private investigators to secretly follow and record you.

It is not building its file to help you; it’s building it to do whatever it can to reduce what it is obligated to pay you.

You May Already Recognize What Happens Next

At first, the bodily injury adjuster may seem helpful.

They initially return your calls. They tell you they are “working on the claim.” They ask you to send them medical bills and records, or to send over a medical authorization. Sometimes they even tell you that you probably don’t need a lawyer.

Then things change. Your calls and emails stop getting returned. You are asked for the same documents again and again. The reasonableness of your medical treatment is questioned. The adjuster suggests your injuries should have healed by now.

Or, often before you have had much, if any, medical treatment and before anyone really knows how badly you were hurt, the adjuster offers you money to settle the claim, often coupled with an offer to pay for $X dollars worth of future medical treatment.

That early settlement offer can seem tempting—especially when medical bills are arriving and you are missing work. Insurance companies know this; they know that many cannot afford to miss work to seek proper medical care. There is a reason insurance companies often want to settle injury claims early. Once you sign the release (or provide a “verbal release” over the phone, the claim is usually over. If, for example, the pain does not go away and an MRI later reveals a serious injury and the need for surgery, or you cannot return to work the way you expected, the insurance company isn’t going to reopen the claim because your injuries turned out to be worse.

They already bought their peace.

Most injured people do not wake up the morning after a wreck wanting to fight an insurance company: They just want their vehicle repaired. They want their medical care paid for. They want to get better and get back to their lives.

Unfortunately, the insurance company approaches the claim differently.
