Can You Be Terminated After Filing A Worker’s Compensation Claim?

June 05, 2013 | Posted in FYI

Due to their many years of practicing personal injury law and employment litigation, the lawyers of Wandres Law are often prompted to answer general questions regarding two of their areas of specialization. Here is an instance where Wandres Law answered a question regarding worker’s compensation wrongful termination claims on the legal advice website, Law Q&A:

Under Oklahoma law, an employer may not discharge an employee because the employee has in good faith filed a worker’s compensation claim, retained a lawyer for representation regarding a claim, instituted any proceeding under the Workers’ Compensation Code, or testified or is about to testify in any such proceeding.  An employee cannot be discharged during a period of temporary total disability (TTD)  solely on the basis of absence from work.

If you have been terminated in retaliation for filing a workers’ compensation claim, you may have a claim for retaliatory discharge.  We would encourage you to promptly speak to a Tulsa Employment attorney from our firm immediately. Contact our office for a free consultation, 1-800-ASK-WLAW.
